These Terms of Service ("Terms") constitute a legally binding agreement between you and DocSign Inc. regarding your use of our website, the DocSign signature creator application, and our secure document management platform (collectively, the "Service"). By accessing or using any part of the Service, you agree to be bound by these Terms.
1. Acceptance and Digital Signature
Your access to and use of DocSign is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By clicking "Sign Up," "I Agree," or by simply using our platform to sign or manage documents, you are providing a digital signature that confirms your agreement to these Terms.
We believe in clarity over complexity. While this document is a legal agreement, we have made every effort to ensure that the obligations and rights described herein are understandable for all users, regardless of their legal background.
2. Description of the DocSign Ecosystem
DocSign provides a comprehensive suite of tools designed to modernize the document signing process. This includes:
- The DocSign Creator: A creative environment where you can handcrafted and sync your unique digital signatures.
- The Secure Vault: A cloud-based storage system where finalized, signed documents are anchored with cryptographic hashes to ensure immutability.
- The Command Center: A dashboard for managing signatures, team collaborations, and document workflows.
3. Responsible Use of Digital Identity
When you use DocSign, you are managing your official digital identity. You agree that:
- 1You will only sign documents that you are legally authorized to sign.
- 2You will not use the Service to impersonate any other individual or entity.
- 3You are solely responsible for the security of your account credentials. Any action taken through your account is considered your own.
4. Legal Validity and Responsibility
DocSign's technology is designed to comply with major electronic signature laws, such as the ESIGN Act and eIDAS. However, the legal validity of an electronic signature can vary significantly depending on your jurisdiction and the type of document being signed (e.g., some regions require physical signatures for wills or real estate deeds).
It is your sole responsibility to ensure that the documents you sign via DocSign are legally admissible in your specific region.
We provide the "Trusted Digital Seal"—a cryptographic proof that a document has not been altered—but we do not provide legal advice. You should consult with a legal professional for specific questions regarding the enforceability of your signed agreements.
5. The "Cloud Delete" Commitment
One of our core commitments to you is the power to remove your data. You may delete your stored signatures and finalized documents from our cloud environment at any time.
When you activate the delete feature, the data is removed from our active servers. However, you acknowledge that DocSign cannot "recall" or delete copies of documents that have already been downloaded or sent to other recipients. We strongly recommend that you maintain your own offline backups of all critical signed documents.
6. Prohibited Conduct and Fair Use
To maintain the security and speed of the Service for everyone, you agree not to:
- Use automated scripts, bots, or scrapers to interact with the platform.
- Attempt to bypass our security layers or "stress test" our infrastructure without written permission.
- Use DocSign to facilitate any illegal activities, including fraud, money laundering, or the distribution of malicious content.
We reserve the right to pause or terminate any account that shows signs of abuse, automated flooding, or violations of these conduct standards.
7. Intellectual Property
The Service and its original content (excluding content provided by you), features, and functionality are and will remain the exclusive property of DocSign Inc. and its licensors. Our branding, logos, and the unique "Trusted Digital Seal" interface are protected by copyright and trademark laws.
8. Limitation of Liability
DocSign is provided on an "AS IS" and "AS AVAILABLE" basis.
To the maximum extent permitted by law, DocSign Inc. shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Service, including but not limited to loss of profits, data, or legal standing due to the use or inability to use electronic signatures.
